Terms of Service

1. Agreement

These Terms of Service (the "Terms") are a binding agreement between The Property Market LLC FZ, 6th Floor Meydan Grandstand, Meydan Road, Nad Al Sheba, Dubai, United Arab Emirates ("we", "us") and the entity or person accessing our website or platform ("you"). By creating an account, activating a trial, or using the services, you accept these Terms. If you act for a company, you confirm you are authorised to bind it.

2. The service

The Property Market LLC FZ provides a cloud-based real estate operating system — five suites and forty-six connected modules covering sales, operations, finance, and people — together with integrations to third-party portals, communication channels, and UAE government systems. Features may evolve; we will not materially reduce the core functionality of a paid plan during its term.

3. Accounts and eligibility

• You must be at least 18 and able to enter a contract under UAE law.
• You are responsible for the accuracy of registration data, for safeguarding credentials, and for all activity under your accounts.
• You must hold any licence your own activity requires (for example a valid real estate brokerage licence and RERA registrations where applicable).

4. Trials, fees and payment

• Trial accounts are provided as-is for evaluation and may be limited or withdrawn at any time.
• Paid subscriptions are billed in advance per the plan you select; fees are exclusive of VAT, which is added at the prevailing UAE rate.
• Invoices are payable within the period stated on them; late amounts may suspend the service after notice.
• Fees are non-refundable except where required by UAE consumer-protection law or expressly agreed.

5. Your data

You retain all rights in the data you and your users enter into the platform. You grant us the limited licence needed to host, process, back up, and display it in order to run the service. We process personal data as described in our Privacy Policy and, for client-managed records, under your instructions as data processor.

You are responsible for the lawfulness of the data you upload, including obtaining any consents required from your own customers, tenants, and employees.

6. Acceptable use

• No unlawful, infringing, or misleading content, and no advertising of properties without the permits UAE law requires (for example Trakheesi permits in Dubai).
• No attempts to breach security, reverse engineer, scrape at scale, or resell the service without a written agreement.
• No use that violates UAE Federal Decree-Law No. 34 of 2021 on Combating Rumours and Cybercrimes or other applicable law.
• AI-assisted outputs are decision support; you remain responsible for decisions taken on their basis.

7. Third-party services

Integrations (portals, government rails such as Dubai REST, Ejari, Trakheesi and Mollak, messaging, payment, and AI providers) are governed by those providers’ own terms. We are not responsible for their availability or acts, though we will use reasonable efforts to keep supported integrations working.

8. Intellectual property

The platform, its software, design, and branding remain our property or that of our licensors. No rights are granted except the subscription licence in these Terms. Feedback may be used to improve the service without obligation.

9. Availability and support

We target high availability with scheduled maintenance announced in advance where practicable. Support channels and response targets are described in your plan or order form.

10. Liability

To the extent permitted by UAE law: neither party is liable for indirect or consequential loss; our aggregate liability in any twelve-month period is limited to the fees you paid for the service in that period. Nothing limits liability for fraud, gross negligence, or anything that cannot be limited under UAE law.

11. Suspension and termination

• Either party may terminate for material breach not cured within thirty days of written notice.
• We may suspend immediately where required by law or to protect the platform or other customers.
• On termination you may export your data for thirty days, after which it is deleted per our retention policy.

12. Governing law and disputes

These Terms are governed by the federal laws of the United Arab Emirates and the laws of the Emirate of Dubai. The courts of Dubai have exclusive jurisdiction, without prejudice to any mandatory consumer rights.

13. Changes and contact

We may update these Terms; material changes take effect thirty days after notice on this page or by email. Continued use after that date is acceptance. Contact: legal@thepropertymarket.com.
